By using our website, social media, emails, messages, free resources, applications, discovery calls, programs or services, you agree to all three parts. If you do not agree, please do not use them. In this page, "Todspot," "we" and "us" mean Todspot LLC, and "our content" means everything listed above.

Part 1: Privacy Policy

Todspot LLC, based in Aventura, Florida, USA, decides how your personal information is used. For data protection laws such as the GDPR, that makes us the "controller." We do not sell your personal information.

We collect only what we need to answer you, run our programs and get paid.

Information about your child

To help your family, we need to know about your child, and sometimes that includes health information, such as how they sleep, eat, poop and pee, or a condition your doctor has told you about. We treat this as sensitive information.

  • We collect it only from you, the parent or legal guardian, and only with your consent. You give consent when you submit an application or intake form, or when you sign the Client Agreement.
  • We use it only to assess fit and provide our services to your family, never for advertising.
  • Within Todspot, only the team members working with your family can see it. The service providers listed below store and process it for us, under confidentiality.
  • You can withdraw consent at any time by emailing us. Withdrawing doesn't affect what we did before, but we may not be able to keep providing services without the information.

Who we share it with

We share personal information only with service providers who help us run Todspot, and only what each one needs. They may use it only to provide their service to us. These include:

  • HighLevel: our website forms, applications, calendar, email, text and WhatsApp messaging
  • Practice Better: our client portal, intake forms and program records
  • Stripe: payments and payment plans
  • Google: email and Google Meet video calls
  • Meta: WhatsApp, Instagram and our ads
  • Website hosting, analytics and AI writing tools (see below)

We may also share information when the law requires it, to protect someone's safety, to respond to a payment dispute or chargeback, or if Todspot is sold or merges with another business. In that last case, this policy would continue to protect your information.

We never share your child's health information for advertising or marketing.

Text messages and WhatsApp

If you give us your phone number and agree to receive messages, we may text or WhatsApp you about your application, calls, program and payments, and, if you opt in, about our content and offers. Message frequency varies. Message and data rates may apply. Reply STOP to stop texts or HELP for help.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information may be shared with subcontractors that support our services, such as messaging and customer service providers. Text messaging opt-in data and consent will not be shared with any third parties.

Cookies, ads and AI tools

Cookies and pixels. Our website uses cookies and similar tools, including the Meta Pixel and analytics, to make the site work, see which pages help, and show our ads to people who visited. Where the law requires it, we ask for your consent first, and you can change your choice at any time through our cookie banner or your browser settings. Blocking some cookies may affect how the site works.

AI tools. We may use AI writing tools to help draft materials, such as a summary of your plan. Your consultant reviews everything before you see it. We choose tools that keep your information confidential and, where the option exists, set them so your information is not used to train their models.

Automated steps. Our application form shows each family the next step that fits their answers, such as booking a call. If you think it got your answers wrong, email us and a person will review it. We do not make decisions with legal or similarly significant effects about you by automated means alone.

Calls. We do not record calls unless you and we both agree.

How long we keep it, and how we protect it

After that, we delete or anonymize it.

We protect information with encrypted connections, password-protected accounts and access limited to the people who need it. No system is perfectly secure. If a breach affects your information, we will notify you and the authorities as the law requires.

Your rights

Depending on where you live, you may have the right to:

  • See the personal information we hold about you and get a copy
  • Correct information that is wrong
  • Have your information deleted
  • Limit or object to how we use it
  • Withdraw consent at any time
  • Receive your information in a portable format
  • Opt out of marketing emails and messages, through the unsubscribe link or by replying STOP

To use any of these rights, email [email protected]. We will reply within 30 days, and we may need to confirm who you are first. We may keep some information when the law requires it. If you are in the EU, UK or another country with a data protection authority, you can also complain to that authority.

International transfers

Todspot is based in the United States, and our service providers may store information in the United States and other countries. If you live outside the United States, your information is transferred there so we can provide the services you asked for. Where the law requires, we rely on safeguards such as our providers' standard contractual clauses.

Children

Our website and services are for adults. We do not knowingly collect personal information directly from children under 13 (or under 16 where local law sets a higher age). Information about children comes only from their parents or legal guardians, as described above. If you believe a child has sent us information directly, email us and we will delete it.

Part 2: Disclaimer

Everything Todspot shares is for education and information only.

Who we are

Todspot was founded by Arianne Argi, a Certified Pediatric Sleep Consultant, Certified Lactation Counselor (CLC), Nurtured Heart Approach® Parent Coach and Certified Oh Crap! Potty Training Consultant.

These are professional certifications, not medical licenses. Unless we clearly say otherwise about a specific person, Todspot's founder and consultants are not physicians, nurses, pharmacists, dietitians, psychologists or other licensed healthcare providers. We do not practice medicine or any licensed health profession.

Not medical advice

Our content is not medical, health, nutritional, psychological or legal advice. It does not replace professional diagnosis or treatment, and we do not diagnose, treat or prescribe.

Always talk with your pediatrician, doctor or other qualified healthcare provider about any question about your child's health or your own. Do this before making changes that could affect your child's health, including changes to sleep, feeding or toileting. Never ignore professional medical advice, or delay getting it, because of something you read, heard or watched from Todspot.

Get medical care promptly if, for example, your child has pain when pooping or peeing, blood in the stool or urine, a swollen or hard belly, vomiting, fever, poor weight gain, fewer wet diapers than usual, pauses in breathing during sleep, or loud snoring most nights. These are examples, not a complete list. If something worries you, call your doctor.

In an emergency, call your local emergency number right away (911 in the United States).

Medications, supplements and products

We may sometimes mention a medication, supplement, stool softener or other product, usually as something to ask your pediatrician about. Any such mention is general educational information only.

Todspot does not prescribe, diagnose or decide doses, and does not decide whether any medication or supplement is right for your child. Never start, stop or change a medication or supplement for your child or yourself without first talking to your child's doctor or your own healthcare provider.

Safe sleep

We support safe sleep. For babies under 12 months, follow the safe sleep guidance of your pediatrician and your country's health authorities (in the United States, the American Academy of Pediatrics). Put baby to sleep on their back, on a firm, flat surface in their own crib or bassinet, with no pillows, bumpers, blankets or soft objects.

Use any sleep strategy we share only within a safe sleep environment. You are responsible for your child's sleep environment and supervision at all times.

Results are not guaranteed

Every child and every family is different. Results vary and depend on many things outside our control, including your child's health, temperament and development, and how consistently a plan is followed. We do not promise or guarantee any specific result from our content, programs or services.

Testimonials. The testimonials and client stories we share are real words from real Todspot clients, shared with their permission. We change their names to protect their privacy. Each one describes one family's experience and is not a promise that your family will have the same result.

Your choices and our liability

You decide what is right for your family. Anything you do based on our content is your voluntary choice and at your own risk, and you remain responsible for your child's care, safety and supervision. Use your own judgment, consider your child's individual needs, and stop and check with a professional whenever something doesn't feel right.

To the fullest extent permitted by law, Todspot LLC and its owners, consultants, team members and contractors are not liable for any injury, loss or damage of any kind arising from your use of, or reliance on, our content. Nothing on this page limits any liability that the law does not allow to be limited.

No client relationship

Reading, watching, commenting on or messaging us about our content does not make you a Todspot client. It does not create a consultant–client, medical or other professional relationship.

A free discovery call is a conversation about whether a program is a good fit. It is not a consultation or an assessment of your child, and nothing said on it is advice for your child.

A client relationship begins only when you sign a Todspot Client Agreement and pay for a program. For clients, the Client Agreement governs our services. If it conflicts with anything on this page, the Client Agreement controls.

Guest experts, community and other businesses

Guest experts. We sometimes invite guest experts, including physicians and other licensed professionals, to share information in live sessions, interviews or posts. Their views are their own and are general education. A guest expert who answers a question in a Todspot session does not become your or your child's healthcare provider.

Community. Comments and advice from other parents in our comments, groups or community spaces are their own opinions, not Todspot's, and we do not check them.

Other websites and products. We may mention or link to other websites, products or services. A mention is not an endorsement or a warranty, and we are not responsible for their content, accuracy, safety or practices. Questions about a product go to its maker or seller.

Caring for you, too

The early years, including the months after giving birth, can bring exhaustion, anxiety, low mood or feelings that don't go away. Our content is not a substitute for mental health care. If you are struggling, please reach out to your doctor or a mental health professional.

If you ever have thoughts of harming yourself or your child, call your local emergency number right away.

Families outside the United States

Todspot is based in Florida, United States. We support families around the world, but medical guidance, safety standards and product availability differ between countries. Follow the guidance of your own healthcare providers and local health authorities.

Part 3: Terms & Conditions

These Terms are a legal agreement between you and Todspot LLC. Together with the Privacy Policy (Part 1) and the Disclaimer (Part 2), they apply whenever you use our content. You must be at least 18 years old, or the age of majority where you live, to use our services.

Our services

Free resources. Our posts, free guides, videos and live sessions are general education for your personal use. They are not personalized advice for your child.

Applications and discovery calls. Submitting an application does not guarantee a call or a place in a program. A discovery call is free and lasts about 20 minutes. It is a conversation about whether a program fits your family, not a consultation or an assessment of your child.

Programs. Our coaching programs are provided only under a signed Todspot Client Agreement. If these Terms and your Client Agreement say different things, the Client Agreement controls. We may decline to work with any family, for example when a program is not the right fit.

Prices, payments and refunds

Prices. Program prices are shared during the application and discovery call, and may change at any time. A price change never affects a program you have already signed for.

Payments. Payments are processed by Stripe. We do not store your full card number. Payment in full is due at enrollment unless we agree in writing to a payment plan. If you are on a payment plan, you authorize us to charge your saved payment method on each due date, as set out in your Client Agreement. You are responsible for any bank, currency-conversion or international fees your bank charges.

No refunds. All sales are final. We do not offer refunds for programs, digital products or other purchases, whether or not you use them, except where the law of the country where you live requires one.

Payment disputes. If there is a problem with a charge, please email [email protected] first so we can fix it. If you file a chargeback or payment dispute, we may pause services while it is open, and we may share your agreement, payment records and communications with the bank or payment processor to respond.

Messages and electronic communications

When you give us your phone number and check the consent box, you agree to receive text and WhatsApp messages from Todspot about your application, calls, program and payments, and marketing messages if you opt in to them. Consent to marketing messages is not a condition of buying anything. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. Carriers are not liable for delayed or undelivered messages.

You agree that we can send you agreements, notices, invoices and receipts electronically, and that electronic signatures are as valid as handwritten ones.

Using our services respectfully

You agree to give accurate information and to keep your client-portal login private. You are responsible for activity under your login.

You agree not to:

  • Harass, threaten or abuse our team or other parents
  • Share private information about another family
  • Post spam, unlawful content, or content that infringes someone else's rights
  • Try to hack, overload or interfere with our website or systems
  • Record calls or sessions without everyone's permission

We may remove content, or suspend or end your access, if you break these rules. For clients, ending services follows the Client Agreement.

Our content and yours

Our content. Everything we create (text, guides, plans, videos, graphics, schedules and methods), and the Todspot name and logo, belongs to Todspot LLC and is protected by copyright and trademark law. You may use it for your own family only. You may not copy, share, resell, teach from or publish it, or use it to train AI tools, without our written permission. Plans and materials made for your family are for your family alone.

Your content. You keep ownership of anything you send or post. We will ask your permission before we repost your content or share your words as a testimonial. When we share testimonials, we change your name to protect your privacy. If you give permission, you can withdraw it later by emailing us. We will stop new uses, though we can't recall content already shared.

Disclaimers and limits on liability

Our content and services are educational and are not medical advice, as explained in the Disclaimer (Part 2). Our website is provided "as is," and we do not promise it will always be available or free of errors.

To the fullest extent permitted by law:

  • Todspot is not liable for indirect, incidental, special or consequential damages, or for lost profits or data.
  • Todspot's total liability for any claim is limited to the amount you paid Todspot in the 12 months before the claim, or US$100 if you paid nothing.

These limits do not apply to gross negligence, willful misconduct, or any liability the law does not allow to be limited.

You agree to cover Todspot's reasonable losses and legal costs from claims caused by your breach of these Terms or your misuse of our content.

Resolving disputes

Talk to us first. If you have a concern, email [email protected]. We'll try to resolve it informally within 30 days.

Governing law. This page is governed by the laws of the State of Florida, USA, and applicable U.S. federal law.

Arbitration. Any dispute we can't resolve informally will be decided by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be based in Miami-Dade County, Florida, and may be held by video. Todspot will pay any arbitration filing fees above what you would pay to file in court.

Small claims. Either of us may instead bring an individual claim in small claims court if it qualifies.

No class actions. Claims may be brought only individually, not as part of a class, collective or representative action.

Your local rights. If you live outside the United States, nothing on this page removes protections you have under the mandatory consumer or data protection laws of your country.

Accessibility

We want our website to work for everyone. If something is hard to use, email [email protected] and we'll help and work to fix it.

General

If any part of this page can't be enforced, the rest still applies. If we don't enforce a term right away, we haven't given up the right to enforce it later. You may not transfer your rights under these Terms. We may transfer ours if Todspot is sold or reorganized. This page is written in English, and the English version controls.

Changes and contact

Changes. We may update this page from time to time. When we do, we change the "Last updated" date at the top, and for important changes we will tell clients by email. Changes take effect when posted, and continuing to use our content after that means you accept them. Changes never alter a Client Agreement you have already signed.
